Member Agreement

AGREEMENT BETWEEN MEMBER AND Belize Portal Limited

This Web site is offered to you, the member (authorized hotel, car or tour company representative) for online reservations of your customers, on condition that you accept without modification, the terms, conditions, and notices contained herein. Your use of this Web site constitutes your agreement to all such terms, conditions, and notices. No other agreement with anyone at Belize Portal Limited is valid.

COMMERCIAL USE LIMITATION

The information contained at this web site and services offered here may not be modified, sold, copied, and transferred to anyone else.  You agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from this Web site. In addition, you agree not to:

                   (i)      access, monitor or copy any content or information of this Web site using any robot, spider, scraper or other automated means or any manual process for any purpose without express written permission of Belize Portal Ltd.;

                 (ii)      violate the restrictions in any robot exclusion headers on this Web site or bypass or circumvent other measures employed to prevent or limit access to this Web site;

                (iii)      take any action that imposes, or may impose, in the discretion of Belize Portal Ltd., an unreasonable or disproportionately large load on the Belize Portal Ltd. infrastructure; or

                (iv)      deep-link to any portion of this Web site (including, without limitation, the purchase path for any travel services) for any purpose without express written permission of Belize Portal Ltd.

HOTEL RATINGS DISPLAYED ON THIS WEBSITE ARE INTENDED AS ONLY GENERAL GUIDELINES, AND Belize Portal Limited AND ITS AFFILIATES DO NOT GUARANTEE THE ACCURACY OF THE RATINGS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. Belize Portal Limited MAY MAKE IMPROVEMENTS AND/OR CHANGES ON THIS WEB SITE AT ANY TIME.  

INDEMNIFICATION

You agree to defend and indemnify Belize Portal Limited and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by

(i)       you or on your behalf in excess of the liability described above; or

(ii)     by third parties as a result of

a.       your breach of this agreement or the documents referenced herein;

b.       your violation of any law or the rights of a third party; or

c.       your use of this website.

NO UNLAWFUL OR PROHIBITED USE

UNDER NO CIRCUMSTANCES SHOULD THIS WEB SITE SHOULD BE USED FOR UNLAWFUL AND OR PROHIBITED PURPOSES, INCLUDING THAT OF HELPING OTHERS TO AQUIRE SERVICES ILLEGALLY AND FOR ANY FORM OF VIOLENT OR TERRORIST ACTIVITIES.

MEMBER CANCELLATION POLICY

Belize Portal Limited is not responsible for refunds and/or any dispute regarding cancellation policies. Once a Customer requests a cancellation, Belize Portal Limited will automatically send an email to you, letting you know that your Customer has requested a cancellation (all Customer’s contact details will be provided).  At that point, it is your sole responsibility to settle this cancellation based on the guidelines you provide in your cancellation policy. 

Once a refund amount has been agreed, you will have to sign into the Member Area (www.belizeportal.com/member), click on the Reservations Tab, find the appropriate Reservation and fill in the amount to be refunded to the customer.  Automatically this amount will be refunded back to the customer from your Internet Merchant Account.  Belize Portal will not be liable for for any refund or any dispute regarding cancellation.

MODIFICATION OF THESE TERMS AND CONDITIONS

Belize Portal Limited reserves the right to change the terms, conditions, and notices under which this Web site is offered. 

TAX RECOVERY

You agree that any tax charged is declared by your respective hotel, car rental or tour company.  You agree that Belize Portal is not the vendor collecting and remitting said tax to the applicable tax authorities and is not responsible for the documented taxes associated with your customer’s reservation. 

GENERAL

This agreement is governed by the laws of the Country of Belize. You hereby consent to the exclusive jurisdiction and venue of courts Belize City, Belize District, in all disputes arising out of or relating to the use of this Web site. Use of this Web site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Belize Portal Limited as a result of this agreement or use of this Web site.

Belize Portal Limited will provide any information contained in its databases to legal authorities if requested upon with proper warrants and authority. The user of this web site agrees to not hold Belize Portal Limited responsible for any outcome of such actions.

Any rights not expressly granted herein are reserved.

You warrant that all information supplied by you about your hotel, car or tour company in this website is true and accurate. Without limitation, any speculative, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited.
